The Construction Industry Security of Payment Ordinance (Cap. 652) (“the Ordinance”) was gazetted on 27 December 2024 and will take effect on 28 August 2025.
In this regard, the Development Bureau (DEVB) has invited application for becoming the Adjudicator Nominating Body (ANB) under the Ordinance. The Hong Kong Institute of Architects (HKIA) and the Hong Kong Institute of Surveyors (HKIS) will apply for becoming one of the ANBs under the Ordinance.
As required under the application, both the HKIA and the HKIS should have their individual panel of adjudicators to be available to provide services for clients with the need for adjudication. As such, Adjudicators Training Courses will be set up for the benefit of members of the HKIA and the HKIS to equip their members with the skills in the adjudication proceeding and be accredited for admission into the panel of adjudicators respectively under the HKIA and the HKIS. These will be courses designed for embracing the knowledge and understanding of the Ordinance.
Those adjudicators currently under the HKIA or the HKIS’s panel of adjudicators will not be automatically recognized under the Ordinance. As such, bridging courses will be organised at a later time (to be announced) for bringing these first panel of adjudicators up-to-date of the knowledge and understanding of the Ordinance so as to be included under the panels of adjudicators and be recognized under the Ordinance
