CPD Seminar: NEC4 Professional Services Contract (PSC)

NEC4 PSC contract is one of the NEC4 suite of contracts which offer a complete project management solution for the entire project life cycle, from planning project delivery, legal relationship and managing projects and beyond. 

NEC4 PSC is normally used in connection with other forms of NEC4 contracts such as the NEC4 Engineering and Construction Contract (“ECC”). To adopt NEC4 PSC, it requires sophisticated management techniques. This sharing session begins with teaching the key knowledge of NEC4 ECC form of contract in terms of its overarching contractual principles of clause 10.1 - all parties shall act as stated in the contract and clause 10.2 – all parties act in the spirit of mutual trust and cooperation, together with the contractual frameworks for problem solving, risks management, change control, programme management, communication protocol and quality management. 

With learning of the basic knowledge of NEC4 ECC, this sharing session of NEC4 PSC will provide key knowledge in contractual relationship and the roles between the Client, the Consultant and the Service Manager, Senior Representatives, Adjudicator and Others such as Contractors. 

 

The Seminar will cover the followings:

  1. Understanding the philosophy of NEC4 PSC. 
  2. Identifying differences between contract strategies under NEC4 PSC. 
  3. Formulating PSC contract documents and their contractual relationships. 
  4. Clarifying roles and responsibilities of key parties (Client, Consultant, Service Manager, Senior Representatives, Adjudicator, Contractors). 
  5. Strengthening Service Manager skills in instructions, early warnings, programmes, design acceptance, and compensation events. 
  6. Enhancing contractual communication on reply periods, submissions, and compensation events. 
  7. Demonstrating how the Service Manager fosters mutual trust and cooperation to achieve project objectives. 

 

Speaker: Mr Raymond Koon Shan AU
Mr. AU has possessed 35 years (10 years in traditional GCC contracts and 25 years in NEC and collaborative contracts) project management experience in private and public sectors from inception through design, construction and final account settlement in leading day to day contract administration for MTR collaborative forms of contracts (Target Cost Contracts) and NEC4 forms of contracts for various mega railway multi-discipline projects and re-provision of Government facilities, covering design consultancy contracts, construction only and design and build, design, build and operate contracts, for building, civil and infrastructure, railway, tunnelling, building services and E&M works, utilities, etc. 
NEC relevant experience 
Mr. AU has designed and delivered the NEC ECC PMA training programme for MTR project management staff, which was accepted by ICE as equivalent standard as NEC ECC training course.
Drafting NEC Contract Documents
Mr. AU has over 25 years' experience in drafting contract documents for traditional GCC contracts and NEC4 form of contract for civil, building, building services and system-wide E&M works construction only and / or design and build lump sum or target cost contracts, including drafting Scope, and constraints.
Mr. AU is currently appointed by the Development Bureau as NEC Advisor to assist in revamping Government general specification and particular specification to align with NEC drafting practice.
